Terms of Use

1. Acceptance of Terms
By accessing or using BugZap ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service.
2. Service Provider
The Service is operated by Piotr Gebski, sole proprietorship (jednoosobowa działalność gospodarcza) registered in Poland.

3. Description of Service
BugZap is a visual bug reporting and tracking platform that provides browser extensions, a web dashboard, embeddable widgets, and a JavaScript SDK for capturing, annotating, and managing software bugs. The Service includes free and paid subscription tiers.
4. Pre-Contractual Information (Art. 12 Polish Consumer Rights Act)
In accordance with Article 12 of the Polish Act on Consumer Rights (Ustawa o prawach konsumenta, Dz.U. 2014 poz. 827 as amended), the following information is provided before concluding a distance contract:
- Main characteristics of the Service: Cloud-based bug reporting and tracking platform with browser extensions, embeddable widget, JavaScript SDK, project management dashboard, team collaboration, and optional integrations (see Section 3)

- Service delivery: Immediate access upon account creation (free plan) or upon successful payment (paid plans)
- Right of withdrawal: 14-day right of withdrawal from the date of purchase. See Section 7.1 for details and the Model Withdrawal Form
- Contract duration: Monthly subscription, automatically renewed until cancelled. You may cancel at any time through the billing portal
- Minimum obligations: None beyond the current billing period
- Functionality and interoperability: The Service requires a modern web browser (Chrome, Firefox, Edge, Safari). The widget and SDK require JavaScript support. Session replay requires DOM access. The Service communicates via HTTPS
- Complaint handling: Contact contact@bugzap.dev. We aim to resolve complaints within 14 days
- Out-of-court dispute resolution: EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr
5. User Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access to your account.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Upload malicious content, malware, or attempt to exploit the Service
- Attempt to gain unauthorized access to other users' data
- Circumvent usage limits or plan restrictions
- Use automated tools to scrape or overload the Service
- Resell access to the Service without written permission
6.1 Widget and SDK Acceptable Use
If you embed the BugZap widget or SDK on your own websites or applications, you additionally agree to:
- Have a lawful basis for collecting data from your end-users through the widget or SDK
- Provide your end-users appropriate notice about data collection, including updating your own privacy policy to disclose the use of BugZap
- Not embed the widget or SDK on websites directed at children under 16 years of age
- Comply with all applicable data protection laws in the jurisdictions where your end-users are located
- Configure appropriate input masking for session replay features to prevent capture of sensitive data (passwords, payment details, personal identifiers)
You agree to indemnify and hold BugZap harmless from any claims, damages, or losses arising from your use of the widget or SDK in violation of this section.
7. Subscriptions and Billing
Paid plans are billed monthly via Stripe. Current pricing is displayed on the BugZap pricing page at bugzap.dev/#pricing. All prices are exclusive of applicable taxes (including VAT). You may cancel at any time through the billing portal. Upon cancellation, your plan will be downgraded to Free at the end of the billing period. We reserve the right to change pricing with 30 days' notice via email.
7.1 Right of Withdrawal (EU Consumers)
If you are a consumer in the European Union, you have a statutory 14-day right of withdrawal from the date of purchase, in accordance with Directive 2011/83/EU and the Polish Act on Consumer Rights (Ustawa o prawach konsumenta).
To exercise your right of withdrawal, you must inform us of your decision by a clear statement (e.g., email to contact@bugzap.dev) before the 14-day period expires. You may use the Model Withdrawal Form below, but it is not obligatory.
Exception under Art. 38(13) of the Polish Consumer Rights Act: If you request immediate access to the paid Service by checking the consent box during checkout, you expressly consent to the commencement of performance before the withdrawal period expires and acknowledge that you will lose your right of withdrawal once the digital service has been fully provided. For ongoing subscription services, you retain the right of withdrawal for the portion of the service not yet performed.
In the event of a valid withdrawal, we will reimburse all payments received from you without undue delay and no later than 14 days from the day we received your withdrawal notification, using the same payment method you used for the original transaction.

8. Intellectual Property
You retain ownership of all content you upload to the Service (screenshots, bug reports, comments). You grant us a limited license to process and store this content solely to provide the Service. We retain all rights to the BugZap software, branding, and documentation.
9. Plan Limits
Each plan has limits on projects, team members, and monthly bug reports. If you exceed these limits, additional submissions may be rejected. Upgrading your plan increases or removes these limits.
10. Data Retention and Export
Bug reports, screenshots, and associated data are retained for the duration of your subscription. Upon account deletion or termination, you have a 30-day grace period to export your data by contacting contact@bugzap.dev. After 30 days, your data will be permanently deleted. Free-tier data may be deleted after 12 months of inactivity with prior email notice.
11. AI-Powered Features
Certain plans include AI-powered features (such as bug summaries) provided via Anthropic's Claude API. AI-generated content is clearly labeled and should be verified by a human before being acted upon. BugZap does not guarantee the accuracy of AI-generated content. Bug report data sent for AI processing is not retained by Anthropic for model training. Only text data (title, description, severity, console logs) is sent for processing — screenshots and session recordings are never sent to AI services.
12. Service Availability
We aim for high availability but do not guarantee uninterrupted service. We are not liable for downtime, data loss, or service interruptions. Planned maintenance will be communicated in advance when possible.
13. Limitation of Liability
To the maximum extent permitted by applicable law, BugZap shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (including liability for fraud or gross negligence under Polish Civil Code Art. 473 §2).
14. Termination
We may suspend or terminate your account if you violate these Terms, with prior notice where practicable. You may delete your account at any time. Upon termination, you have 30 days to export your data (see Section 10). After the export window, your data will be permanently removed.
15. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you disagree with changes, you may terminate your account before the changes take effect.
16. Governing Law and Disputes
These Terms are governed by the laws of Poland. Any disputes shall be resolved in the courts of competent jurisdiction in Poland. If you are an EU consumer, you retain the right to bring proceedings in the courts of your country of residence. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
